LEGAL QUESTIONS ABOUT MINE ON COURT DOCKET
BRANFORD - Legal actions to stop the Suwannee American cement plant
continue
to crawl through the American court process. The appeal to the 1st
District
Court of Appeals on the Suwannee County Commission¹s approval
of the site
plan on the basis of a ³resource based activity² is set of
oral arguments on
Jan 24, 2001. At this point the court will consider serious questions
raised
by the two sides and will hear supporting arguments as well as review
the
written record.
In a second action, the appeals judges may get to
hear
arguments saying the Florida Department of Environmental Protection
was
amiss in its granting a permit to SAC. Environmentalists filed legal
action
saying the operation would add additional amounts of mercury in a river
system that has been designated by the state as ³outstanding Florida
waters². According to records, the Alachua County Commission agreed
to side
with anti-cement plant groups and plan to file a friend of the court
brief
and join in the legal actions to stop the operation just east of Branford.
